Can police release you without taking you to court?

Criminal Procedure Code · sources read 4 Oct 2026

Yes. The officer in charge of the police station can release you on a bond to appear in court on a set date, unless the offence looks serious, and must consider this if you can't be taken to court within 24 hours. The officer can also release you if police inquiries don't turn up enough evidence to go on with the charge.

Where
The police station where you are held: ask the officer in charge (OCS)
Read the law

Steps

  1. Ask the officer in charge of the station (OCS) to release you on a bond to appear in court on a date written in the bond.
  2. If police inquiries have not found enough evidence to go on with the charge, the OCS can release you.
  3. Sign the bond (with sureties if asked). It binds you to attend court at the time and place in it until told otherwise.
  4. If you are not released, police must bring you before a court within 24 hours, where you can ask for bail.

Watch out

  • Police can't release you themselves for murder, treason or robbery with violence, but you still have a constitutional right to bail on reasonable conditions unless a court finds compelling reasons.
  • Being released on bond does not end the case: the OCS reports every arrest without warrant to the nearest magistrate, whether or not you were released.
  • Once released on bond, you only have to appear before the magistrate on the set date, not report to a police station.

Who this covers

  • People arrested without a warrant for any offence other than murder, treason, robbery with violence and attempted robbery with violence.
