Community service instead of jail: who qualifies
Community Service Orders Act; Probation and Aftercare Service · sources read 3 Oct 2026
A court can order unpaid public work in the community instead of jail when the offence carries up to 3 years, or when the court decides a jail term of 3 years or less fits. The work cannot last longer than the jail term would have, and a probation officer reports on you before the order is made.
- Where
- The court that convicts you decides. The Probation and Aftercare Service (the Probation Office at or near the court) supervises the order.
Steps
- Before making the order, the court sends a community service officer (a probation officer) to look into your case and circumstances. Cooperate with this inquiry; the court reads the report to decide if you are suitable.
- Right after sentencing, contact your Community Service Officer or the Probation Office.
- Report to the supervising officer named in the order, do the work assigned for the period ordered, and tell them if you change address.
- If something important changes, ask for a review of the order in writing through the community service officer or supervising officer. In special circumstances you can apply to the court directly.
Watch out
- Not available for convictions under the Sexual Offences Act, the anti-FGM law, the Anti-Corruption and Economic Crimes Act, the Bribery Act, the Prevention of Terrorism Act or the anti-money-laundering law.
- If you break the order, the court can summon or arrest you, and may cancel the order and give you another sentence, which can be jail.
- A conviction dealt with by community service is ignored for laws that disqualify people with convictions, unless the order is set aside and you are re-sentenced for the offence.
Who this covers
- People convicted of an offence punishable by up to 3 years in jail, with or without a fine option.
- Also offences with longer maximum terms, where the court decides 3 years or less is the right sentence.
- The Probation and Aftercare Service says you need a fixed place to live and must be willing to do the work and follow the conditions.
