Is it legal to form or join a private militia?
Public Order Act; Constitution of Kenya, 2010 · sources read 4 Oct 2026
No. Being a member of a group organised, trained or equipped to take over the work of the police or the Kenya Defence Forces, or to use or show force for political aims, is an offence with a fine of up to KSh 100,000, up to 2 years in jail, or both. The Constitution also bans anyone from setting up a private military or paramilitary group.
- Where
- Any police station, or call 999, 112 or 911
Steps
- To report such a group or get help in an emergency, call the police hotlines 999, 112 or 911 (free), or go to the nearest police station.
- Organising a public meeting on private premises? You may hire a reasonable number of stewards to help keep order.
Watch out
- Organisers, trainers and leaders face up to 3 years in jail, a fine of KSh 2,000, or both.
- The Cabinet Secretary can, by order, ban the wearing of such a group's uniform, distinctive dress or emblem in public places or at public meetings. Breaking that order is an offence.
- A prosecution for belonging to or running such a group needs the consent of the Director of Public Prosecutions.
- The Act sets no special penalty for breaking a uniform ban order, so the general penalty applies: a fine of up to KSh 50,000, up to 6 months in jail, or both.
Who this covers
- Everyone: members and supporters of such a group commit an offence.
- Anyone who promotes such a group, helps run it, or organises, trains or equips its members.
- Political parties: a party must not set up or keep a paramilitary force or militia.
- Anyone setting up a military, paramilitary or similar group that claims to protect national security, unless the Constitution or an Act of Parliament provides for it.
