What you need

  • The power of attorney, properly signed (executed)
  • Proof you paid stamp duty
  • Certified copy of your ID or passport, KRA PIN certificate and 2 passport-size photos

Steps

  1. Draw up the power of attorney saying what your agent may do (for example sign documents, sell, lease or develop the land), and sign it.
  2. Pay stamp duty of KSh 200 for each donor and keep the receipt.
  3. Lodge it at the land registry with the stamp duty receipt, your ID or passport, PIN certificate and 2 photos, and pay the KSh 1,000 registration fee.
  4. Once registered, your agent's authority is on record and banks and government offices can rely on it.

Watch out

  • The Registrar won't accept land documents signed by an agent unless a properly executed and verified power of attorney backs them.
  • The registry keeps the original on file (or a copy certified by the Registrar, if the Registrar agrees), so make your own copies first.
  • Stamp duty is charged per donor, so if two owners give the power, it's KSh 200 each.

Who can apply

  • Any land or property owner who wants to give someone else (the agent) authority to act for them on land matters.
