Land Control Act · sources read 3 Oct 2026
Yes. Within 30 days of getting the board's written decision, you can appeal to the land control appeals board for the area where the land is, and if that fails, to the Central Land Control Appeals Board within another 30 days. The Act makes the appeal boards' decisions final.
- Deadline
- 30 days from delivery or posting of the board's decision to appeal to the area appeals board.
- Deadline
- 30 days from the appeals board's decision to appeal to the Central Land Control Appeals Board.
- Where
- Appeals go to the land control appeals board for the area where the land is (still called the provincial board in the Act), then to the Central Land Control Appeals Board.
Steps
- Get the board's written decision. When consent is refused, the decision must state the reasons.
- Within 30 days of the decision being delivered or posted to you, appeal to the land control appeals board for the area where the land is (the Act still calls it the provincial board).
- If that appeal is dismissed, you can appeal to the Central Land Control Appeals Board within 30 days of that decision.
Watch out
- If you don't appeal in time, or your appeals fail, the sale or other agreement becomes void.
- The Act says the Central Board's decision is final and can't be questioned in any court.
- Boards must refuse consent to sell, transfer, lease, exchange or partition farmland to people outside the groups the Act allows, such as non-citizens.
Who this covers
- The applicant whose request for Land Control Board consent was refused.
