Once the court has confirmed the grant, take Form LRA 39 or LRA 42, the letters of administration, the confirmed grant, the original title and stamp duty proof to the land registry. Registration costs KSh 1,000 plus a KSh 2,500 title fee and takes about 3 days.

What you need

  • Completed Form LRA 39 or LRA 42
  • Letters of administration and the certificate of confirmation of grant from court
  • Original title deed and proof of stamp duty payment
  • Copy of ID or passport, KRA PIN certificate and 2 passport-size photos

Steps

  1. First finish the court part: get letters of administration and then the confirmation of grant (see the succession service).
  2. Fill Form LRA 39 or LRA 42 for the land.
  3. Pay the stamp duty and keep the receipt. Get the original title deed of the deceased.
  4. Lodge everything at the land registry and pay KSh 1,000 registration plus KSh 2,500 title fee. The registrar checks the documents and registers the heirs.

Watch out

  • Letters of administration alone are not enough. The registry also needs the confirmation of grant.
  • You need the original title deed. If it is lost, replace it first.

Who can apply

  • Beneficiaries of a person who has died, named in a will or under a grant of letters of administration (usually the administrator lodges it).
