What happens if KRA doesn't decide your objection in 60 days
Tax Procedures Act; Kenya Revenue Authority · sources read 5 Oct 2026
KRA must decide your objection within 60 days of receiving a valid objection. If it doesn't, the law treats your objection as allowed.
- How long
- KRA must decide within 60 days of receiving the objection or the extra information it asked for
- Where
- On the KRA iTax portal; appeals go to the Tax Appeals Tribunal
Steps
- Lodge a complete, valid objection on iTax: precise grounds and reasons, all relevant documents, and the undisputed tax paid (or more time to pay it applied for).
- Keep a record of the date KRA received your valid objection. The 60 days count from that date.
- If KRA decides against you in time, you can appeal to the Tax Appeals Tribunal.
Watch out
- The 60 days only run from when KRA receives a valid objection, so an incomplete objection does not start the clock.
- This only works for a validly lodged objection. If KRA finds yours isn't valid, it must tell you in writing within 14 days and ask for the missing information, which you then have 7 days to send.
- A decision KRA does make must be in writing, with its findings and reasons.
Who this covers
- Taxpayers whose notice of objection was validly lodged within time
