What you need

  • A copy of the NEMA decision, licence or order you are appealing

Steps

  1. File your appeal on the Judiciary e-filing portal (efiling.court.go.ke), choosing the National Environment Tribunal, within 60 days of the decision.
  2. The portal works out your filing fee. Pay it and keep the receipt.
  3. Can't file online? The tribunal registry will help. Office: DRSRS building, Popo Road, South C (Belle Vue), Nairobi (nettr@court.go.ke).

Watch out

  • Filing an appeal doesn't freeze things on its own. If you want the project or order paused until the appeal is decided, ask the tribunal for a status quo order.
  • Unhappy with the tribunal's decision? You can appeal to the Environment and Land Court within 30 days.

Who can apply

  • Anyone aggrieved by NEMA granting, refusing or transferring a licence or permit, its conditions, a revocation or suspension, the fee charged, or a restoration or improvement order.
  • Other decisions of NEMA, its Director-General or committees can also be appealed here, unless the law says otherwise.
  • The tribunal also hears appeals on forestry matters and on wildlife compensation awards.
