Steps

  1. Tell the supplier you are cancelling. The notice can be in any form, spoken or written, as long as it shows you want to cancel.
  2. Once you cancel, the supplier must refund what you paid under the agreement.
  3. If they refuse, you can complain to the Competition Authority of Kenya by post, email, phone or at its offices.
  4. You can also take the matter to the appropriate court.

Watch out

  • These rules do not cover services run on a non-profit or co-operative basis, or by a private club mainly owned by its members.
  • A supplier may not take payment for services that are not yet available when you pay.
  • Only one joining (initiation) fee is allowed, and it cannot be more than twice the annual membership fee. A contract cannot run longer than one year after all services become available.

Who this covers

  • Consumers of services for health, fitness, diet, modelling and talent, martial arts, sports or dance, including the facilities and instruction.
  • Applies where you must pay in advance and the total you could owe is above an amount set by regulations.
