What you need

  • The National Land Commission decision or award you are challenging

Steps

  1. File your appeal online on the Judiciary e-filing portal (efiling.court.go.ke), choosing the Land Acquisition Tribunal. Do it within 30 days of the NLC decision.
  2. Can't file online? The tribunal registry will help you. Office: Ground Floor, Kenya Re Towers, Upper Hill, Nairobi (lat@court.go.ke).
  3. Watch for your hearing dates on the Causelist portal or Kenya Law. If your phone number is linked to your e-filing account, you'll get an SMS too.

Watch out

  • If the tribunal finds you should have been paid more, it can order the NLC to pay interest on the extra amount.
  • Filing fees depend on the type of case. The e-filing portal shows the fee, or ask the tribunal.
  • You can appeal the tribunal's decision to the Environment and Land Court, but only on a point of law.

Who can apply

  • Anyone dissatisfied with a National Land Commission decision in the compulsory acquisition process.
  • Disputes over compulsory acquisition, wayleaves, easements and public rights of way go to this tribunal first.
