How much notice to end a rental with no end date
Land Act · sources read 5 Oct 2026
If your lease has no fixed end date and no notice clause, it is a periodic tenancy, and either you or the landlord can end it with notice at least as long as the rent period (one month if rent is monthly), ending on a rent day. Renting with no written agreement counts as a periodic tenancy too.
- Deadline
- Notice must be at least one rent period long and end on a rent day.
- Where
- Notice goes directly to your landlord or tenant; disputes go to the Environment and Land Court or a magistrate's court
Steps
- Work out your rent period: it is how often rent is due, for example monthly.
- Give the other side notice at least as long as that period, timed to end on a day rent is due.
- If you can't agree, disputes under the Land Act go to the Environment and Land Court or a magistrate's court with power to hear them.
Watch out
- For agricultural land, a periodic lease is treated as six-monthly.
- If your fixed lease ended and you stayed on with the landlord's consent, it becomes a periodic tenancy unless you agreed otherwise.
- A verbal agreement is still a valid lease: short-term leases can be oral or written.
Who this covers
- Tenants and landlords whose lease has no fixed term and no notice clause.
- Anyone renting at a rent without a written agreement.
