What you need

  • Your appeal or application (the form for that rule), with any annexures
  • A copy of the KIPI decision you are appealing (if you are appealing)

Steps

  1. File your appeal or application on the Judiciary e-filing portal (efiling.court.go.ke), choosing the Industrial Property Tribunal.
  2. The portal works out your fee. Pay it and keep the receipt.
  3. Can't file online? The tribunal registry will help you file. Office: Weights & Measures Building, Popo Road, South C, Nairobi (ipttr@court.go.ke, 0769 731 276).

Watch out

  • If you don't live in Kenya and have no main place of business here, you pay the foreign fee in US dollars instead (US$400 for an appeal).
  • The tribunal's listed areas are patents, industrial designs, utility models, technovations and semiconductor technologies. Trade marks are not on that list.
  • Unhappy with the tribunal's decision? You can appeal to the High Court.

Who can apply

  • Anyone unhappy with a decision of the KIPI Managing Director on a patent, industrial design, utility model, technovation or semiconductor technology.
  • Kenyans, foreigners and companies with rights under a patent, industrial design or utility model, and members of the public who benefit from those rights.
  • Owners who want to stop infringement: the tribunal can order an injunction or damages.
