What you need

  • Proof that you first tried the party's internal dispute resolution mechanism (IDRM), unless you are appealing the Registrar or are an independent candidate

Steps

  1. Take the dispute to your party's internal dispute resolution mechanism (IDRM) first.
  2. If it isn't resolved, file your case at the Tribunal on the Judiciary e-filing portal (efiling.court.go.ke).
  3. Can't file online? Go to the PPDT registry at Milimani Law Courts (Ground Floor, Chamber 31) or a regional registry and they will help you file.

Watch out

  • The Tribunal only takes a case after you have tried the party's internal dispute process. Appeals against the Registrar of Political Parties and disputes between an independent candidate and a party are exempt.
  • You don't have to travel to Nairobi: there are regional registries at the law courts in Mombasa, Kakamega, Eldoret, Nyeri, Meru, Embu and Kisumu.

Who can apply

  • Disputes between party members, a member and their party, political parties, an independent candidate and a party, or coalition partners. Also disputes from party primaries and appeals against the Registrar of Political Parties.
