Oppose a trademark application

Within 60 days of the KIPI Industrial Property Journal that advertised the mark, file Form TM6 (two copies) with your grounds and pay KSh 5,000 for the first class. Warn the applicant in writing first.

What you need
- Form TM6, Notice of Opposition, filed in duplicate
- A statement of your grounds for objecting (written on the form)
- Your eCitizen payment receipt
Steps
- Check KIPI's Industrial Property Journal (published monthly on kipi.go.ke under IP Journal) for the mark you object to and note its application number and journal date.
- Write to the applicant first, giving them a fair chance to withdraw before you file.
- Generate an invoice for the opposition on KIPI's eCitizen (kipi.ecitizen.go.ke) and pay.
- Submit Form TM6 in duplicate, with your grounds and the eCitizen receipt, to the Registrar of Trade Marks at KIPI before the 60 days run out.
Watch out
- Need more time? Ask the Registrar for an extension before the 60 days end.
- If you skip the warning letter and the applicant doesn't contest, that can count against you when costs are decided.
- You can see the advertised mark itself at the Trade Marks Registry at KIPI Centre, Lavington.

- Anyone who has grounds to oppose a trademark advertised in the KIPI journal.
