Go to CAK

What you need

  • Evidence, for buyer power cases: contracts, LPOs, delivery notes, invoices, goods received notes and messages between you
  • Attachments in PDF format
  • A confidentiality claim form, if you want parts of your information kept confidential

Steps

  1. Create an account on the CAK e-filing portal (competition.cak.go.ke:444) and log in.
  2. Open File a Complaint and pick Restrictive Trade Practices Complaint (cartels, abuse of dominance) or Abuse of Buyer Power.
  3. Fill every section first, then upload your evidence as PDFs and submit.
  4. You get an automatic confirmation. Follow your case on the portal and answer any CAK request for more information or an interview.

Watch out

  • CAK expects complaints on matters that are not already before a court or the Competition Tribunal.
  • If your own company is in a cartel, the first to come forward under the leniency programme can get full immunity from penalties.
  • A complaint about being overcharged or misled as a shopper is a consumer complaint, which CAK handles separately.

Who can apply

  • Anyone can complain to CAK about restrictive trade practices.
  • Cartels: agreements or coordinated conduct between businesses that prevent, distort or lessen competition.
  • Abuse of dominance: being big is allowed, abusing that position is not (for example unfair prices or blocking market access).
  • Abuse of buyer power: for example a big buyer paying suppliers late without good reason, or delisting them unfairly.
