Settle a case through Court Annexed Mediation, or register a private mediation agreement
The Judiciary of Kenya · sources read 2 Oct 2026
If your case is already in court, you can both ask the court to send it to mediation, and an accredited mediator then has 60 days to help you agree. A signed settlement is adopted by the court and becomes a court order you can enforce.
- Fee
- We couldn't confirm a fee from the official page. Check it there before you pay.
- How long
- Mediation is concluded within 60 days of the mediator's appointment (the court can add up to 10 days)
- Where
- Through the court handling your case. Private agreements are filed online by the mediator on Judiciary e-filing (efiling.court.go.ke). CAM Secretariat: Reinsurance Plaza, opposite the Supreme Court, Nairobi
What you need
- For a private agreement: the written agreement, dated and signed by the mediator, the parties and any advocates
- The mediator's affidavit (Form 15, CAM Rules 2022) with the agreement attached
Steps
- Ask the court, together with the other side, to refer your case to mediation. Courts also screen cases for mediation once pleadings close.
- Meet with the accredited mediator. Mediation must finish within 60 days of the mediator's appointment.
- If you agree, the settlement is filed and the court adopts it as an order or decree you can enforce like any other.
- Private agreement: the mediator uploads it on Judiciary e-filing within 30 days of signing. To enforce it later, file Form 16 (Notice of Motion).
Watch out
- You can't appeal a court order that comes from your own settlement, so read it carefully before signing.
- Child neglect, sexual offence, SGBV, terrorism and other criminal cases can't go to private mediation.
- A court-annexed mediator who holds sessions at their own office must not charge you for it.
Who can apply
- Parties to a case in court, at any stage before final judgment.
- For a private agreement: a dispute not pending in court, settled with a qualified mediator.
